01
Start with the fact, not the answer you want
Rather than asking to prove the other party wrong, identify the disputed signature, work quantity, damage cause or calculation. Determine which object could answer the question. Wording should not predetermine the conclusion. A useful question is specific enough to matter and falls within the specialist’s expertise. Separate several tasks packed into one sentence so that broad wording does not obscure an important part of the examination or make the expected scope unclear.
02
Match the question to the available material
Do not assume any question can be answered from a photograph or incomplete documents. Explain which originals, copies, specimens and source records exist and what is missing. A specialist can assess feasibility and limitations. Refining a question may be more useful than commissioning extensive work that cannot answer it. Where material must be obtained through proceedings, its provision needs to reflect the particular case and the participants’ authority to obtain or supply it.
03
Do not replace legal decisions with specialist questions
A technical cause, material composition or meaning of a statement differs from guilt, a legal violation or which party should win. Those require legal assessment by the competent authority. In Russian judicial proceedings, final questions and appointment follow the applicable process. Preliminary discussion can help prepare proposals but does not replace the court’s decision. A consultation can produce a clear list of questions and materials for appropriate use in the next stage.

Can I describe the question in my own words?
Yes. Understanding the situation comes first. The wording can then be refined into a testable question within the relevant expertise.
Will the expert decide the legal dispute?
No. Specialist examinations help establish facts. Their legal significance and the dispute’s outcome are assessed through the applicable process.
